General Terms and Conditions (GTC) for private customers in Austria of My Solo OG on mysolo.at

§1 SCOPE AND DEFINITIONS

(1) The following General Terms and Conditions apply to all deliveries between us and a buyer in the version valid at the time of the order.

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity (§ 1 Austrian Consumer Protection Act).

(3) A business is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its commercial or independent professional activity (§ 1 Austrian Commercial Code).

(4) For the purposes of these GTC, buyers are both consumers and businesses.


Section 2 CONCLUSION OF A CONTRACT, STORAGE OF THE CONTRACT TEXT

(1) The following provisions regarding the conclusion of a contract apply to orders placed via our online shop https://www.mysolo.at.

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but is merely a non-binding invitation to the buyer to order goods. By ordering the desired goods, the buyer submits a binding offer to conclude a purchase agreement.

Acceptance of the offer is made in writing or text form, or by dispatching the ordered goods within one week. After this period has expired without acceptance, the offer is deemed rejected.

(4) The following provisions apply upon receipt of an order in our online shop: The buyer submits a binding offer to enter into a contract by successfully completing the order process provided in our online shop.

The order process consists of the following steps:

Selection of the desired goods
Confirmation by clicking the "Order" button
Review of the items in the shopping cart
Clicking the "Checkout" button
Logging in to the online shop after registration and entering the login details (email address and password)/or ordering as a guest
Binding submission of the order by clicking the "Place order" button
Completion of payment
Before submitting the order, the buyer can review their information and correct any errors by clicking the "Back" button in their web browser. Alternatively, they can cancel the order process by closing the web browser. We will immediately confirm receipt of the order by sending an automatically generated email (order confirmation). This does not yet constitute acceptance of the offer. Acceptance of the offer is made in writing, in text form, or by dispatching the ordered goods within one week.

(5) Storage of the contract text for orders placed via our online shop: We will send you the order details and our Terms and Conditions by email. You can also view the Terms and Conditions at any time at https://www.mysolo.at/agb.

§3 PRICES, SHIPPING COSTS, PAYMENT, DUE DATE

(1) The prices quoted include statutory VAT and other price components. Shipping costs are additional.

(2) The buyer has the option of paying by prepayment, PayPal, or credit card (Visa, Mastercard, American Express).

(3) If the buyer has chosen prepayment, they are obligated to pay the purchase price immediately after conclusion of the contract.

§4 DELIVERY

(1) Unless we have expressly stated otherwise in the product description, all items offered by us are ready for immediate dispatch. Delivery within Austria usually takes 2 business days, but can take up to 7 days. For other countries, delivery can take up to 12 business days. The delivery period begins, in the case of payment in advance, on the day after the payment order is issued to the bank responsible for the transfer, and in the case of all other payment methods, on the day after the contract is concluded. If the last day of the delivery period falls on a Saturday, Sunday, or public holiday at the delivery location, the period ends on the next business day.

(2) The risk of accidental loss or accidental damage to the goods sold passes to the buyer or an authorized recipient upon delivery of the goods to both businesses and consumers.

§5 RETENTION OF TITLE

(1) We retain title to the goods until full payment of the purchase price.

Section 6 Right of Withdrawal for Consumers

(1) Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity.
